Employment Permit Holders – What to Do if Made Redundant

If you are an employment permit holder and are made redundant, here is what you need to know.

What Is Redundancy?

  • Redundancy occurs where an employee’s position ceases to exist and the employee is not replaced.
  • This is usually due to the employer closing the business or reducing the number of staff.
  • You will usually be informed in your notice that the reason for the work ceasing is due to redundancy.

What Do You Need to Do?

You must take the following steps:

  • Fill out the Redundancy Notification form (found here) and send it to the DETE within 28 days of the redundancy.
  • Send it by registered post to Employment Permits Section, Department of Business, Enterprise and Innovation, Earlsfort Centre, Lower Hatch Street, Dublin 2.
  • Keep the tracking number from your registered post as proof that you submitted the form within 28 days. You may need this evidence later.

 

What Happens Next?

Once you have submitted the form, you have 6 months to apply for a new Employment Permit with a new employer. The new permit will not need a Labour Market Needs Test (28 day advertisement) before the application is made.
