The EU Treaty Rights Division has recently released the following information:
If you are a non-EEA national in Ireland and are the parent of an EU citizen child (not an Irish citizen) you may be eligible to apply for residence on this ground.
This is based on two European court rulings, the Chen judgement and the Ibrahim/Teixeira judgements.
Here are the eligibility criteria:
Chen judgement-
- You are a non-EU national resident in Ireland
- You are the primary carer of an EU citizen child who is residing in the State
- The EU citizen child is under 18 years old and is a citizen of any EU member state except Ireland
- You have comprehensive medical insurance and sufficient resources
Ibrahim/Teixeira judgement-
- You are the parent or primary carer of a child of an EU National who works or has worked in Ireland and the child is engaged in full time education in Ireland
- You have comprehensive medical insurance and sufficient resources
How to apply:
- Log in to your account on the ISD Customer Portal
- Raise a query and select category “EU Treaty Rights”
- State whether it is the Chen or Ibrahim/Teixeira form you are requesting and your home address.
The selected form will be posted. Once completed, it can be posted, along with any necessary documentation, to the following address:
